Court rejects to cheat | | | Early TIMES REPORT Jammu, June-06 (JNF):- Judicial Magistrate RS Pura Manjeet Rai today dismissed the bail application filed by one Jaswinder Singh who allegedly on fake documents got cash credit facility to the tune of Rs 20 lacs and declared defaulter in payment of bank money to the tune of Rs 23, 65, 709. According to the police case that Manager Citizen Cooperative Bank RS Pura filed a written complaint to the effect that Jaswinder Singh Prop M/S Pooja Traders requested Citizen Cooperative Bank RS Pura for cash credit facility for his business purpose and accordingly cash-credit limit of Rs 8 lacs was sanctioned in his favour on December 13, 2007 which was further enhanced to Rs 20 lacs on July 11, 2008 against hypothecation of stocks, but on enquiry it was found that the land which was mortgaged was not on his name. The police registered a case u/s 420/467/468/471 RPC and arrested the Jaswinder Singh. The Court after hearing the parties observed that keeping in view the facts and circumstances and seriousness of the offence for the commission of which the accused has been arrested, Court considered that it is a case involving serious fraud and huge amount of cheating forgery, creation of false documents in order to obtain loan from the bank, as such Court is satisfied that there is no prima-facie case made for grant of bail to the accused and as such application of bail is dismissed. |
