Court awards 10 years RI, fine to Narco Smuggler | | | EARLY TIMES REPORT Jammu, June-08 (JNF):- Principal Sessions Judge Kathua Jang Bhadur Singh Jamwal today awarded 10 years rigorous imprisonment and fine Rs 1 lacs to Palli Shah /s 15(b) NDPS Act for possessing 3.700 KG Bhukhi. According to the police case on September 7, 2004 the police on their regular patrol duty at Lakahnpur intercepted one gas tanker which coming from the side of Jammu and going towards Punjab. On inquiry, the driver of tanker disclosed his name has Palli Shah, the Gas Tanker was checked, one gas cylinder was lying in the tool box of the tanker and on checking inside, found bukhi which was weighed came to be 3.700 KG. After completion of the investigation challan was presented in the Court under NDPS Act. The Court after hearing the parties observed the manner in which the offence has been committed by the accused was found carrying bukhi 3.700 KG concealed in a gas cylinder which is more than small quantity and less that commercial quantity. The accused cannot be believed that he was not commercially involved for indulgence in the business of narcotics. These kinds of people have spoiled the entire society and fungus has extended to the entire territory of India and is spreading like a wild-fire and likelihood that it will engulf in the entire country. Court further said that if timely action and appropriate punishment is not implanted on the accused, the younger generation the lot more affected and attracted towards intoxication such substances and accordingly awarded rigorous imprisonment for 10 years and fine Rs 1 lacs under NDPS Act to accused Palli Shah s/o Jani Shah r/o village Banjal Tehsil Rajkot District Ludhiana, Punjab. Court further said that in default of payment of fine he shall suffered imprisonment for period of two years. JNF JNF/JUNE/08/2011/2
