Alleged removal of President MC Reasi challenged

Jammu, Nov 22
In a Writ petition filed by Mr. Kuldeep Kumar Mengi claiming to be President Municipal Committee Reasi and two Councillord Mr. Sudesh Puri and Sheel Kumar Sharma challenging the order of Executive Officer Reasi Municipal Committee for removal of President, Justice Nirmal Singh of J&K High Court today after hearing Sr. Adv AV Gupta with Advocate Yasser Ejaz Tak appearing for the petitioners, issued notice to J&K State through Commissioner/ Secretary Housing and Urban Development Department, Director Urban Local Bodies Jammu and Executive Officer Municipal Committee Reasi with the directions to the counsel for the respondents to appear with the relevant record on next date of hearing.
In the petition it has been submitted that petitioners are elected Councillors of Municipal Committee Reasi, whereas the petitioner Kuldeep Kumar Mengi is President of the said Municipal Committee. On November 9, 2006, a notice of intention to move no confidence motion against the President was sent to the Director Urban Local Bodies Jammu. The said respondent further directed Executive Officer to immediately take necessary action in the matter. The Executive Officer on November 10, 2006 notified the members of the Municipal Committee Reasi for holding discussion on No Confidence Motion. The President returned the said notice with the direction that the meeting may be fixed on November 18, 2006 on No confidence motion and if need arises conduct secret ballot voting in view of pressure tactics used by some political parties to win over the members of the Municipal Committee.
According to the petition, the Vice President called for voting to be done by secret ballot and no votes were polled till 2.00 PM, which was time fixed for the end of meeting. It is further submitted that the Executive Officer who happens to be Secretary of the Municipal Committee Reasi did not adhere to the directions of the Chairman of the meeting for the conduct of secret ballot as he was playing in the hands of members of the opposite party, who is a ruling party in the state and vide order No MC/R/702 dated November 18, 2006 issued by Executive Officer whereby the President Mr. Kuldeep Kumar Mengi has been held to have been removed by so called no confidence motion as President of the Municipal Committee Reasi. This order was challenged in the State High Court with prayer for quashing the same.
