| Pakistan has again revived the call for a thousand years war with India. Hafiz Syed, the mastermind of 26/11 and Chairman of Jamaat ud Dawa during his bitter anti India speeches on Kashmir solidarity day again hit out at India saying that if India does not resolve the Kashmir problem India should be made to face a nuclear war. We should not take these threats lightly in the belief that USA will never allow a war between India and Pakistan. We should try our best to build bridges with Kashmiris so that peace returns to J&K and the aspirations of Kashmiris are satisfied to a large extent. For that we have to win over the hearts of the Kashmiri separatists who have an insatiable hunger for "azaadi". To do this we have to make some proposals out of the box and out of the routine so that the separatists come forward for a dialogue with India and the Govt. of India has to send out those suggestions. Now let us see how such feasable proposals can be made without affecting the sovereignty of India. J&K has three distinct regions, Kashmir, Jammu and Ladakh. The cry for "azaadi" is more or less limited to the Kashmir valley which has eight districts. People of Jammu and Ladakh have not so far raised such demands of secession from the Indian union. We therefore have to think of extraordinary solutions for Kashmir valley leaving Jammu and Ladakh as normal parts of India. In other words we have to trifurcate the state of J& K as the first step towards a solution of Kashmir. India cannot, obviously grant or offer full "azaadi" to Kashmir valley because that will endanger the security of Jammu, Punjab, Himachal Pradesh and Ladakh. If granted full "azaadi" the government of Kashmir valley may befriend the known enemies of India and throw the doors open for them and their terrorists and infiltrators. Govt. of India, therefore has to keep the ministries of Defence and External affairs with themselves while granting a high degree of autonomy or semi- independent status to the Kashmir valley within the political map of India. Powers of all other departments and ministries could be delegated to the Prime Minister of this semi-independent territory of Kashmir comprising of the eight districts of Anantanag, Pulwama, Srinagar, Budgam,Ganderbal, Baramullah, Kupwara and Bandipore. The Kashmiris will have Indian passports and Indians will not need any visa for entering Kashmir. The Indian army will remain in Kashmir. The Kashmiris can have their own currency and Reserve Bank, their own airways and television, their own income tax and customs department. They may have their own Election Commission for holding elections to the Kashmir Parliament. We may leave it to the parliament of Kashmir to decide as to whether Supreme court of India should have jurisdiction over Kashmir or not. To have the jurisdiction of Supreme court in Kashmir will mean protection of the rights of the Kashmiris through the benevolent hands of the Supreme court and I feel the parliament of Kashmir will ask for the continuation of Supreme court jurisdiction. Jammu and Ladakh will get chief ministers of their own and will become integral parts of India without the hassles of article 370 of the Indian constitution. Article 370 will be automatically abrogated since the present state of J&K will be automatically dissolved. For implementing this scheme of things Govt. of India will have to go through constitutional amendments through all party consensus. This is by no means an easy task, but for solving the complicated Kashmir problem we have to go through some difficult processes. It would be ideal if we could take Pakistan on board for this solution. Perhaps they would ask for visa free access to the Kashmir valley by seeking special permits from the government of Kashmir. Those details have to be sorted out by GOI through dialogue. If the govt of India sends out such proposals the seperatists will hopefully come forward for dialogue because a vast majority of Kashmiris will be happy with this. People of Jammu and Ladakh will be simply overjoyed. After taking the agreement of Huriyat Conference, JKLF, Democratic Freedom Party etc. through open dialogue GOI could proceed further. I feel that the two mainstream parties of Kashmir may have some objections to this proposal because they may feel uncomfortable if the present administrative setup of J&K is abolished. However, in national interest and for solving the long pending Kashmir problem GOI will have to remove those objections and obstacles. I Retd.former Financial Commissioner, J&K. |
