Commissioner granted conditional pre-arrest bail | | | EARLY TIMES REPRT JAMMU, June 11: Special judge anti-corruption, A K Koul today granted conditional pre-arrest bail to revenue commissioner Aijaz Iqbal allegedly booked by state vigilance organisation (SVO) in a corruption case. A case was registered against him by SVO on May 19 last under sections 5(2), 5(1) (c) read with section 5(1) (d) of prevention of corruption Act 2006 read with sections 120-B, 420, 468 and 471 of RPC. According to the FIR, the petitioner was alleged to have misused his official position in his capacity as managing director of state financial corporation (SFC) in October 2008 after hatching a criminal conspiracy with his the beneficiaries. The judge observed that as the petitioner was revenue commissioner, there was virtually no chance of his fleeing justice. The IO has a statutory right to conduct investigation, but how his custodial interrogation was going to help the prosecution had not been clearly spelled out. The court directed Iqbal to join investigation and fully cooperate
with the investigating agency. However, in the event of his arrest, he would be released on bail on his furnishing personal bond to the tune of Rs 50,000 and one surety of the like amount. The petitioner would also desist from coming in contact with the witnesses or temper with the documentary evidence which was in the process of being collected by the IO. Breach of these conditions might entail the petitioner to the cancellation of bail, the court ordered.
