HC directs Principal B.Ed College to allow petitioners to attend classes

Controversy over two notifications issued by Controller of Examination, Board of Professional Entrance Examinations issued on October 7, 2006 and October 18, 2006 has been challenged by the candidates who claim to be selected vide notification No 80 of October 7, 2006.
Justice Nirmal Singh of J&K High Court Jammu wing after hearing Advocate Surinder Kour and Advocate Onkar Seth appearing for the petitioners directed Principal Government B.Ed College Canal Road Jammu to allow the petitioners to attend the classes as the petitioners have already been admitted on the basis of recommendation made by Board of Professional Entrance Examination. In case the petitioners succeeded in the petitions then they will not be able to appear in the examination, as there will be shortage of lectures as per the norms fixed by the University.
The petitioners aggrieved by the revised notification issued by the BOPEE on October 18, 2006 filed these petitions in which it has been submitted that petitioners are graduates and post-graduates. In pursuance to an advertisement notice issued by the BOPEE, they applied for admission in B.Ed Course. The respondents in which the names of the petitioners figured published a select list. Accordingly the BOPEE made recommendations regarding admission of the petitioners in the Government B.Ed College. Petitioners deposited the fees and were admitted but after few days of their admission, Board of Professional Entrance Examination issued a revised list in which the names of the petitioners did not figure on the ground that there was an error in applying the key to the series. The Principal Government B.Ed College Jammu directed the petitioners not to attend the classes, which was challenged in the present writ petitions. While allowing the petitioners to attend the classes, Justice Nirmal Singh directed respondents that they shall file the reply within two weeks.
