No Lambardar without election: HC | | | Early Times Report Jammu, June-21 :- Vacation Judge Justice JP Singh today held that lamabardaar cannot be appointed except by election. In a petition filed by Des Raj & Ors candidate for the post of Lambardar Village Dewan Garh RS Pura, has issued notice to the State of J&K through Commissioner/ Secretary Revenue & Ors returnable within one week and after hearing Adv BL Kalgotra for the petitioner directed that Lambardar for village Dewan Garh Tehsil RS Pura of District Jammu shall not appointed except by election in terms of Rule 17 of J&K Lambardari Rules 1980 till next date. In the petition it has been submitted that post of Lambardar of village Dewan Garh fell vacant due to the death of previous Lambardar Asha Singh. It is further submitted that in the petition that Rule 17 of Lambardari Rules provides that vacancy of lambardar shall be filled by election. It has been alleged in the petition that the official respondents tried to fill the post by traditional feudal system of appointment by nomination. The petitioners are also candidates. They submitted that official respondents tried to appoint private respondent Vachitar Singh by underhand methods on the basis of his political clout. In the petition it has been prayed for issuance of direction to the official respondents to obey and implement the order of High Court and proceed to hold election under Lambardari Rules and fill the post of Lambardar of Dewan Garh village.
