Despite court orders, Kishtwar youth still languishing in UP jail | Desperate father appeals PM, CM, HM and Azad for release of his son | | Asif Iqbal Naik kishtwar, June 21: Despite court orders issued by Special Judge SC/ST Act Lucknow regarding the release of 25 year old Sajjad Hussain@Sajjad-ur-Rehmin, who was earlier believed to be behind the triple blasts, that took place on November 23, 2007 in Lucknow, Faizabad and Varanasi in Uttar Pradesh is still languishing in UP jail. The three blasts rocked the courts in Lucknow, Faizabad and Varanasi in which 13 persons lost their lives and several others got injured. Remembering the tragic morning of 22nd December, 2007, Ghulam Qadir Wani, the desperate father of Sajjad-ur-Rehman, who wants his son released from jail in UP said that on that day, Sajjad went to nearby house for Qurbani, when police arrived at his residence in Kuchal Chatroo in search of Sajjad, he said that Sajjad returned very happily after being called and have a chat with the police officer gracefully. His father further said that when he came to know about his involvement in the UP blast after some days, his smile went off and said that he was innocent, as pronounced by the recent Judgment of the Special Judge SC/ST Act Lucknow. Sajjad's father now made his appeal to Prime Minister Manmohan Singh, Chief Minister Omar Abdullah, Home Minister P Chidambaram and Union Health Minister Ghulam Nabi Azad for the release of his son his as the the verdict given by the special court in UP has absolved his son Sajjad-ur-Rehman from all the charges framed against him by the UP police. In his judgment, Special Judge SC/ST Act Lucknow in a case Khalid Mujahid and others verses prosecution of accused person, the court in his judgment dated April 14,2011 stated that four persons Khalid Mujahid, Mohammad Tariq Kazmi, Sajjad-ur-Rehman and Akhtar@Tariq Kashmiri were produced in the court for their involvement in UP serial blasts and were facing charges U/S 115/120B/307/121/122/124A IPC 3/4,5/6 Explosive- Substance Act, 15/18/10 of unlawful Activities (Prevention) Act is made out against all the four accused persons on the basic of evidence and material collected and produced along with the charge sheet in the court. However the counsel for the defense submitted that the prosecution has no evidence or any other material related to the involvement of the accused Sajjad-ur-Rehman with present incident, except confessional statement of the accused before the police officer which are not admissible in evidence and hence no charges for the offence under section U/S 115/120B/307/121/122/124A IPC 3/4,5/6 Explosive- Substance Act, 15/18/10 of unlawful Activities (Prevention) Act against the accused Sajjad-ur-Rehman is not made out The Judge while delivering his judgment stated that learned ADGC (Criminal) has not been able to spell out the bases on which it proposes to establish the charges except confessional statement of the accused, which is not admissible in evidence .The Judge in his judgement said that he was of the considered opinion that prima facie case for framing charging for the offence under section 115/120B/307/121/122/124A IPC 3/4,5/6 Explosive- Substance Act, 15/18/10 of unlawful Activities (Prevention) Act is not made out against the accused Sajjad-ur-Rehman as there is nothing tangible evidence to establish any charges against him (Sajjad-ur-Rehman) and therefore the judge while pronouncing his judgment said that Sajjad-ur-Rehman deserves to be discharged and exempted After pronouncing the Judgment, the Special Judge directed the UP police to discharge the Sajjad-ur-Rehman from present case and issued direction for his release if not wanted in some other case. Whereas the other three accused Khalid Mujahid, Mohammad Tariq Qazmi and Akhtar@Tariq Kashmiri have been found guilty for commission of offence punishable under law. Knocking the doors for justice, Ghulam Qadir Wani, the father of Sajjad approached the CM Omar Abdullah, Ghulam Nabi Azad, UP State Human Right Commission from time to time in search of the justice since last 4 years. He said that he had even written a letter to UP Chief Minister Mayawati, PM Manmohan Singh and Union Home Minister. |
