| Beacon authorities ‘bypass’ court order | | | Srinagar, June 24: The Beacon authorities have allegedly bypassed a court order and carried out works which had been stayed by the High Court. M/s Imtiyaz Ahmad Shah approached the court of Justice Hasnain Masoodi on June 21, 2011 with the petition seeking interim relief after the Beacon authorities cancelled contract number CE (P) BCN/52/2007-08 allotted to the firm. In the cancellation order the Chief Engineer Beacon, TPS Rawat said that works as defined in the contract condition of the general conditions of the contract will now be completed through other agency/departmentally at the risk and costs of M/s Imtiyaz Ahmad Shah. Aggrieved over the cancellation order 800892/175/E8 dated 3 June 2011 the firm moved to the court seeking stay order. The Court vide OWP No 729/2011, CMP No 1193/2011 passed an interim order asking respondents Union of India and others not to re-allot the contract work in question till next date of hearing. The court listed the case of July 4. However, Advocate Manzoor Ahmad Lone, the legal advisor of the firm Friday alleged that Chief Engineer Beacon bypassed the court order and were carrying out the work despite stay order. “When I talked to Officer in charge Vijay Kumar why he is working on the particular site when it is stayed by the court he said ‘I am working on the directions of the Chief Engineer Beacon,” Advocate Lone alleged. “The Chief Engineer Beacon is taking advantage of vacations in the High court and carrying out the work which had been stayed by the High Court. We will file a contempt petition against the Beacon authorities after the vacations are over,” he told. Advocate Lone also appealed higher ups in the BRO to take cognizance of the matter.
