Age limit for recruitment as cop is 28 yrs: DB | | | EARLY TIMES REPORT JAMMU, June 28: A high court division bench of Justice Hakim Imtiyaz Hussain and Justice Sunil Hali today said upper age limit for recruitment as a cop in police department was 28 years as per rules. The DB directive came in a petition filed by a SSP against the April 9, 2008, writ court judgement which said the upper age limit was 35 years. The DB held that for the recruitment of a constable in state police department, the rule applicable prescribed 28 years as maximum age limit and in view of the rules, article 37 of J&K CSR was not applicable to such recruitment. The maximum and minimum age for government service was prescribed under article 37 of CSR but this provision applied only in cases where the government had not prescribed a different age limit for a particular service. Posts in police were to be filled up in accordance with the rules applicable to the department and as contained in the police manual and relevant rules in this behalf prescribed that maximum age limit was 28 years, the DB observed. Thus the maximum age limit for appointment of police constable was 28 years as provision of the civil service regulation would not apply in such cases. The DB, after going through the judgment found that the issue had already been dealt with by a high court DB. Due reasons had been recorded in arriving at the conclusion. The DB found correct view on the interpretation of the rules and the appreciation of the issue had been taken. This DB found no ground to take different view and allowed the appeal filed by police against the writ court judgment and set it aside.
