SC to hear petition on J&K Rehabilitation Policy on Monday

New Delhi, July 1:

The Vacation Bench of the Supreme Court of India comprising Justice P. Sathasivam and Justice A.K. Patnaik today decided to fix the matter challenging the Cabinet Order of J&K Govt. to facilitate return of the militants from Pakistan.
The petition has been filed by the J&K National Panthers Party challenging the decision of the Union Home Ministry and the Govt. of J&K which has cleared the return of about 100 trained terrorists in Pakistan and rehabilitate them back in J&K. Rehabilitation of about 1300 more militants is in the pipeline whose return to J&K has been recommended by Omar Abdullah Govt. and the Union Home Ministry has registered no objection.
Prof. Bhim Singh appearing for the petitioner urged the court for urgent hearing as this act on the part of the Union Home Ministry and the National Conference Govt. in the State shall threaten the security of the state and disturb communal harmony.
The court after hearing Prof. Bhim Singh ordered the matter to be listed on Monday, the first day of the reopening the Supreme Court after summer vacation.
Prof. Bhim Singh submitted that the Supreme Court of India had issued stay on the operation of the Resettlement Act, 1981 which had a similar provision ensuring return of the Kashmiri Migrants who had voluntarily migrated to Pakistan in 1947. He said the Govt. of J&K in its colourable exercise has tried to achieve the same objectives by ensuring return of those militants who had migrated to Pakistan 21 years back voluntarily and since had undergone armed trained, could be even associated with Al-Qaeda. In its petition the Panthers Party has urged the Supreme Court of India to stay the operation of the so-called ‘Rehabilitation Policy for those who are no more citizens of India and have indulged in waging war against India. Their return amounts to causing threat to the security of the country.
