HC stays Tehsildar’s order | | | Early Times Report Jammu, July-02 (JNF):- Vacation Judge of Jammu & Kashmir High Court Jammu Wing Justice JP Singh has stayed the operation of Tehsildar Nazool Jammu dated June 10, 2011 requiring the petitioners Kanwar Sein Anand and Ors to surrender the possession of land measuring 2 Kanal 5 Marlas and 120 Sft situated at Danis Gate Jammu, until further orders from this Court. The petitioners have challenged the Tehsildar Nazool Jammu’s notice dated June 10, 2011 whereby they have been directed to surrender the possession of land measuring 2 Kanals 5 marlas and 120 Sft comprised in Khasra No 330 min situated at Denis Gate Jammu (in the heart of city). Sr. Adv KS Johal assisted by Adv Amit Gupta appeared for the petitioners submitted that initial forty years period of lease commencing from October 1, 1974 in respect of the property in question sanctioned vide Govt order No Rev (NAJ) 408 December 20, 1976 having not yet expired. The Tehsildar Nazool's demanded for surrender of possession was unwarranted and illegal. After hearing the parties the Court observed that petition needs consideration and issued the notice to the respondents and stayed the operation of order of Tehsildar Nazool. JNF JNF/JULY/02/2011/1
