VOJ filed report in bail application filed by then Director CAPD

Jammu, July-02 (JNF):- On the direction of Special Judge Anticorruption Jammu in pre-arrest bail application of Hemant Kumar Sharma then Director CAPD allegedly in FIR No 10/2011 P/S VOJ. In compliance of order of the Court dated June 28, 2011 VOJ has filed report seeking custody of accused persons for further investigation of the case.
In report it has been submitted that a verification conducted into the matter has revealed that M/S Hemant Kumar Sharma then Director CA&PD Jammu, Saif-ud-Din Giri, Krishan Kumar Sharma & Zaffar Ullah Bhat all are then Assistant Directors CAPD of District Ramban and contractors namely M/S Ghulam Rasool Bhat , Towseer Ahmed, Mohd Rafiq Paddar, Abdul Gani and Fayaz Ahmed all resident of village Assar Tehsil Banihal entered into a criminal conspiracy during the year 2009 and in pursuance, the above mentioned officers of CAPD dept did not enter into contract agreement with four new successful bidders (lowest tenders) relarting to transportation of food grains in different areas of District Ramban. The officers of CAPD Dept dishonestly and wrongfully allowed the four contractors for the transportation job on much higher rates, rates quoted and approved in respect four successful and bidders and thus caused wrongful loss to the tune of Rs 25, 67, 106/- to the State Exchequer and wrongful gain to the accused persons.
This report has been filed in all the applications filed by the alleged accused persons involved in the FIR NO 10/2011U /s 5(2) r/w section 5(1) (d) J&K PC Act 2006 and 120-B RPC registered with VOJ and further submitted that investigation of the case is at initial stage and the relevant original record is yet to be collected from the concerned dept. The statements of conversant with the facts of the case are yet to be recorded. The accused persons being very influential may influence the prosecution witnesses, whose statements are yet to be recorded and may also temper the prosecution evidence. The custody of accused persons is required for further investigation of the case as the nexus of the accused officers with the other accused officials/persons needs a thorough probe into the matter and requested for rejection of the pre-arrest bail applications filed by the accused.
