HC issues notice to CM, CS | Restoration of SAC | | Early Times Report Jammu, July 6 : The High Court today issued notice to the Chief Minister and the Chief secretary in apetition seeking restoraion of the state accountability commission (SAC). Justice Mansoor Ahmed issued notice to the State of Jammu & Kashmir through Secretary and Chief Minister (in his Capacity as Chairman of the Committee for appointment of Chairperson and Members of J&K Accountability Commission). The notice was accepted by the Gagan Basotra Additional Advocate General. Court directed that reply be filed by or before July 25, 2011. The petitioner Virender Sudan whose complaint along with 272 complaints sought a direction for appointment of chairperson and various members of the SAC to ensure effective administration of justice to the people. The petition filed through Advocates AK Sawhney with Advocate Aseem Sawhney submitted that the whole nation was vying for Lok Pal to fight the menace of corruption. In the State of J&K virtually a Lok Pal had taken birth in the year 2002 and was made functional in 2004/2005 but the inaction on the part of respondents have virtually rendered this institution infructious as the Commission's Chairman and the members have not been appointed since four/five years. The petitioner has submitted that every appointment be made after obtaining the recommendation of a committee constituting of Chief Minister as Chairman, the Speaker of Legislative Assembly, and Chief Justice of the State High Court Member, Law Minister of the State Member and Leader of Opposition in the Legislative Assembly as Member. After the resignation of Late Justice RP Sethi (Retired Judge of Supreme Court of India), the respondents never appointed Chairperson but senior member Justice GL Raina (Rtd) was made the acting Chairperson and after his expiry of terms neither any member was appointed nor any chairperson was appointed. Justice Muzaffar Jan (rtd) was the lone member leaving the SAC defunct and lifeless and institution which was made for the people and to check the politician, executive and police was made lifeless and defunct, seeking appointment of Chairperson and members of the SAC. The petitioner prayed before the Court for issuance a mandamus directing and commanding the respondents to appoint the chairperson and members of the State Accountability Commission and restore the function of the Jammu & Kashmir Accountability Commission. |
