Jammu, July-07 (JNF):- State Vigilance Organization has booked Kunal Sharma Tehsildar Reasi, Rattan Singh Naib Tehsildar Katra, Hukum Chand Circle Girdawar, OM Parkash Patwari Halqa Village Kundorian Katra, Swarn Singh Salaria r/o Village Chaotana, Pathankote (Punjab) and Harbans Singh r/o Bishnah District Jammu in a Rs 9.55 Crores Revenue Stamp Duty Scam.
According to the Vigilance case that as per the verification conducted into allegation that above said public servants with private beneficiaries conspired amongst themselves and in pursuance thereof, the above mentioned revenue officers/ officials by abusing there official position dishonestly and fraudulently prepapred and issued incomplete and misleading the revenue extract in respect of land measuring 52 Kanals 18 Marlas under Khasra NO 11 Min situated under Village Kundorian Katra Reasi falling under Katra Develeopment Authority, in fvaour of private beneficiaries.
During verification, it transpired that above mentioned revenue/officers/officials knowingly and willfully omitted to mention that the “otelH Hotel White” already stood constructed over the land and existed on the aforesaid land while preparing and issuing revenue extracts thus intentionally and dishonestly facilitating private beneficiaries Swarn Singh Salaria and Harbans Singh to depreciate the value of property from its actual assessment of about Rs 195 Crores to Rs 35.00 lacs only private beneficiaries thus paid stampy duty to the tune of Rs 2, 52, 000/- only.
During verification it has been further reveled that Swarn Singh Salaria had obtained a loan of Rs 1500 lacs from IDBI Bank Mumbai in June, 2010 against the aforesaid property and the while assessing the property of Swarn Singh Salaria in form of land and “Hotel White” the surveyor had assessed the value of property to the tune of Rs 194, 25, 24,478/-. This assessment had been agreed to by the beneficiary and IDBI Bank Mumbai while mortgaging the aforesaid property for the loan of Rs 1500 lacs. Since, the land in question falls under Katra Development Authority as per notification of Divisional Commissioner Jammu which was effective at the time of slae of land, it was valued at Rs 25.00 lacs per Kanal for the purpose of stamp duty to be paid by purchaser. Thus total stamp duty on the land alone was to be paid at Rs 95, 22, 000/-. Whereas, the stamp duty on the super structure of said land was to be paid to the tune of Rs 8.64 Crores. In the process loss to the Govt exchequer in the form of revenue stamps duty to be paid on sale of aforesaid property has been to the tune of Rs 9.55 Crores.
After completion of the verification State Vigilance Organization registered a case against Kunal Sharma Tehsildar Reasi, Rattan Singh Naib Tehsildar Katra, Hukum Chand Circle Girdawar, OM Parkash Patwari Halqa Village Kundorian Katra, Swarn Singh Salaria r/o Village Chaotana, Pathankote (Punjab) and Harbans Singh r/o Bishnah District Jammu u/s 5(1) (d) r/w 5(2) J&K PC Act 2006 SVT and 120-B RPC under FIR No 12/2011. According to source no arrest was made. JNF
