Court rejects bail in Durganagar Sex Scam

JAMMU, Jul 8 (JNF): Chief Judicial Magistrate MS Parihar today dismissed bail application of Ashish Abrol allegedly involved in much publicized Durganagar Sex Scam.
CJM Jammu MS Parihar after hearing CPO Pawan Khajuria with PO Rajeshwar Basotra for state observed that accused is not entitled to bail because allegations against the accused are serious in nature regarding commission of offence u/s 376 RPC with a minor girl and there is every apprehension that the grant of bail to the accused at this stage will hamper the investigation of the case and more over, the two co-accused have been already refused bail in instant case.
With these observations Court dismissed the bail application of the accused. According to the police case that on May 26, 2011; complainant lodged a written report with Police Station Domana to the effect that the complainant is 15 to 16 year old and a resident of village of Kishtwar and her parents have expired.
She is also having no brother and sister. One Santosh Devi, resident of her Village and married at Durga Nagar Jammu visited her house at Kishtwar and told her that she will solemnize her marriage with a handsome boy in Jammu. By enticing the complainant for getting her married, she was forced to have illicit inter-course with unknown persons without her consent.
She further disclosed that she was taken by the alleged accused to Dalhousie, Patnitop and Manali where she was raped by different persons. The prosecutrix during the investigation has been got medically examined from Govt Hospital Sarwal. According to the medical report prosecutrix has been subjected to sexual intercourse and her age as per opinion given by radiologist is about 14 to 16 years.
Prosecutrix has identified about 7 persons including the application as accused who have raped her on different times at different places at the instance of accused Santosh Devi. Police has arrested the said seven person and all of them are in the judicial custody as per police report.
