Court denies pre-arrest bail to former Director, 3 Asst Directors CAPD

Jammu, July-11 (JNF):- Special Judge Anticorruption Jammu Pawan
Dev Kotwal today rejected bail applications of then CAPD Director
Hemant Kumar Sharma presently Special Secretary to Higher Education
Dept, Saif-ud-Din Giri, Krishan Kumar Sharma & Zaffar Ullah Bhat all
are former Assistant Directors CAPD of District Ramban and contractors
namely M/S Ghulam Rasool Bhat, Towseer Ahmed Paddar, Mohd Rafiq
Paddar, Abdul Gani and Fayaz Ahmed allegedly involved in much
publicized food grain transport scam to the tune of 25, 67, 106/-.
In report it has been submitted that a verification
conducted into the matter has revealed that M/S Hemant Kumar Sharma
then Director CA&PD Jammu, Saif-ud-Din Giri, Krishan Kumar Sharma &
Zaffar Ullah Bhat all are then Assistant Directors CAPD of District
Ramban and contractors namely M/S Ghulam Rasool Bhat , Towseer Ahmed,
Mohd Rafiq Paddar, Abdul Gani and Fayaz Ahmed all resident of village
Assar Tehsil Banihal entered into a criminal conspiracy during the
year 2009 and in pursuance, the above mentioned officers of CAPD dept
did not enter into contract agreement with four new successful bidders
(lowest tenders) relarting to transportation of food grains in
different areas of District Ramban. The officers of CAPD Dept
dishonestly and wrongfully allowed the four contractors for the
transportation job on much higher rates, rates quoted and approved in
respect four successful and bidders and thus caused wrongful loss to
the tune of Rs 25, 67, 106/- to the State Exchequer and wrongful gain
to the accused persons.
The court is of view that allegations leveled in the
FIR are prima-facie well-founded and the investigation of the case is
at the initial stage and therefore apprehension of the prosecution
that in case of grant of bail, the accused will influence the
witnesses is not unreasonable. Admittedly, the petitioner Hemant Kumar
is on high position in the state bureaucracy and though he ceases to
be Director CA&PD but is holding an important post as admitted by the
parties and therefore, influencing the witnesses and tempering with
the prosecution evidence in the hands of petitioners cannot be ruled
out. With these observations Court dismissed the bail applications.
