CJM denies bail to murder accused | | | EARLY TIMES REPORT Jammu, July-14 (JNF):- CJM Jammu MS Parihar dismissed the bail application of Rakesh s/o Mangu Ram r/o Jorin Road Tehsil Akhnoor who is allegedly involved in murder of Surinder Kumar alias Shinda and also in unnatural offence committed with a victim. According to the police Ranjit Singh alias Rishu who was having old enmity with the deceased got a chance in a party which was arranged to celebrate the election of Sarpanch and he with kirch attacked the deceased Surinder Kumar and inflicted five injuries on his chest and injured him critically and thereafter he ran away from the place of occurrence. The deceased was taken to GMC but in the way he succumbed to the injuries. According to the police the accused Ranjit Singh had committed murder of Surinder Kumar who has been arrested on June 6, 2011 and the offence u/s 377/34 RPC has been proved against accused Sham Singh alias Shama and Rakesh Kumar who have been arrested on June 29, 2011. The police in the report has mentioned that the complainant in his statement recorded u/s 164-A CrPC has narrated that Rakesh Kumar the applicant has taken with him the deceased on the date of occurrence in the party and Balbag near the bank Chenab River and accused Sham Singh alias Shama was also present in the party and there role in connection with the murder of deceased is yet to be investigated. CJM Jammu Mohan Singh Parihar after hearing Advocate PN Raina assisted by Advocate Sushil Sharma appearing for the applicant/accused whereas CPO Pawan Khajuria along with PO Rajesh Bastora appeared for the State, observed that the investigation in the case is under process and as per the police the role of accused Rakesh Kumar who took the victim in the party is yet to be ascertained regarding his involvement in the murder offence. From the perusal of the police report it reveals that simply by mentioning in the report u/s 377 RPC is proved against accused Rakesh Kumar, he cannot be admitted to bail as his role in the murder case is yet to be investigated by the police as stated in the report and the bail application is dismissed.
