Court's intervention can save Dal Lake | | | Judicial activism seems to have unnerved the executive in the entire country.Right from 2-G and 3-G scams,to the commonwealth Games scandles and to the police action on Yoga Guru Baba Ramdev courts have intervened in one form or the other in order to motivate or compel the Government to act fast against the culprits and against those who have been involved in scams of various hues.A stage has come when the courts cannot but intervene when their doors are knocked by the aggrieved parties or individuals.And it is because of repeated court interventions that an element of scare has gripped those who are known for corrupt practices,who are adept in human rights violations.And Jammu and Kashmir state has begun experiencing the benefits of this very judicial activism.And the latest pertains to the conservation and beautification of the world famous Dal Lake in Srinagar.Over the years despite heavy yearly allocations on Dal development plan and commitment of ruling politicians to save the Lake from total extinction the progress of the plan has been snail like slow. And it is now the State High Court that has issued directions to the Lakes and Waterways Development Authority(LAWDA) to shift the houseboats from the Boulevard side to the western foreshore so that the lakes beauty was restored. In order to do away with the congestion in Dal Lake along the Boulevard Road, the High Court has directed the Lakes And Waterways Development Authority to shift the houseboats to the Western Foreshore Road.Hearing the Dal case, the Division Bench comprising Chief Justice FM Kalifullah and Justice Muhammad Yaqoob Mir directed the LAWDA to come forward with a proposal to shift the houseboats from Boulevard to the Western Foreshore Road and organize them in one line to clear the congestion in the Dal along the Boulevard Road.For the rehabilitation of Dal dwellers, the court directed the LAWDA to submit an Action Plan for providing free alternate lands along with the proposed payment of compensation for the existing structures as well as land. Besides, the Court directed to provide ex-gratia compensation of Rs one lakh each to the affected persons. Right from 1975 the then Chief Minister,Sheikh Abdullah,had conceived a plan of building a foreshore where all the houseboats could be moored.His idea was to clear the Lake of congestion.However,his idea could neither be fulfilled till he was alive and headed the Government nor his successors took keen interest in implementing the plan letter and spirit.Had his plan been executed by now a large number of structures and gardens built on the lake waters would have been removed.It is strange that the successive state Governments have identified the areaa where those who had built houses on lake waters were to be rehabilitated after those houses were demolished as part of the main scheme of rmoving enroachment.Only the Government knows what factors have come in the way of speedy rehabilitation of those to be pulled out of the houses built on the lake.It is hoped that the High Court sets up a committee for monitoring the response of the Government and the Authority to its direction so that the conservation and beautification of the Lake were carried out without waste of time and money. |
