Police file closure report after 5 yrs in corruption case | | | EARLY TIMES REPORT Jammu, July-15 (JNF):- The Gandoh police filed the final report in a case of corruption allegedly committed by a head constable. The Special Judge Anticorruption Jammu Pawan Dev Kotwal after going through the final report held that under the Prevention of Corruption Act no police officer below the rank of Deputy Supt of Police shall investigate any such offence without order of a Magistrate or make an arrest without a warrant. However, in the present case the investigation conducted by ASI and none of the senior officer in the hierarchy took note of this legal aspect and rather allowed the investigation to be conducted and completed and report is also submitted without noticing the illegality of the investigation. The investigation is therefore, vitiated and consequently the report cannot be looked into any act upon. Court directed SSP Doda that he shall entrust the investigation to an officer of the rank of Deputy Supt of Police or above, who shall conduct the investigation without being influenced by the earlier investigation. Since the complaint seems to be made in the year 2006 and investigating agency already took five years to complete the investigation, the court directed IO that he shall make an endeavors to complete investigation as early as possible and submit report.
