| Court awards 15 years RI to Pak National | | | Jammu, Nov 27 Principal Sessions Judge Jammu Mr. Subhash Chander Gupta today awarded 15 years rigorous imprisonment and fine of Rs 8000/- to a Pakistani National U/Ss 14 FA, 3,4, 7 r/w section 25 of Arms Act. According to the prosecution case, a police naka party apprehended a Pakistani National at Pargwal near Peer Baba on August 23, 2003. During search, map of J&K, 30 photographs of valley and photographs of Agra, Fatehpur Sekri were recovered from the apprehended national. During the investigation the police on the disclosure of Mohd Tariq s/o Mohd Alam Gujjar r/o Khuduwali Tehsil Peeror District Sialkote, Pakistan got recovered a Grenade, one Chinese Pistol, 30 live cartridges, two magazines, one knife with blade of seven inch length and 4.5 inch breadth and another knife with 3.5 inch length blade were recovered. The accused was charged for commission of offences u/s 14 Foreigner Act and sections 3,4 ad 7 r/s section 25 of Arms Act. The prosecution witnesses in their categorical statements and specifically stated that they were holding a naka near Peer Baba Pargwal and around 9:30 PM, they saw the accused coming from Pargwal side and after seeing the Naka party he ran away. After a hot chase he was caught at a distance of 40/50 yards. Principal Sessions Judge after hearing Public Prosecutor Mr. E A Tak appearing for the State and Advocate Dinesh Verma (ami-cus-curia) for the accused, observed that looking to the young age of the accused and the prayer to live a peaceful life with his family in Pakistan, the Court considered five years rigorous imprisonment and fine of Rs 5000/- for commission of offence u/s 7/25 Arms Act, three years rigorous imprisonment and fine of Rs 1000/- for commission of offence u/s 3/25 Arms Act, three years rigorous imprisonment and fine of Rs 1000/- u/s 4/25 Arms Act and four years rigorous imprisonment and fine Rs 1000/- for the commission of offence u/s 14 Foreigner Act shall meet the ends of justice and same are accordingly awarded. Court further ordered that all the sentences shall run concurrently. In default of payment of fine on counts, the accused shall further under go RI for a period of six months. |
