Selection of 20 Pharmacists challenged
HC orders appointments subject to final out come of petition
11/27/2006 11:56:34 PM

Jammu, Nov 27
Justice Nisar Ahmed Kakroo of J&K High Court Jammu wing in a writ petition challenging the selection of 20 pharmacist, today issued notice to State of J&K, Chairman J&K Service Selection Board, Secretary JKSSB, Administrative Officer JKSSB and 20 selected candidates ordered that selection/appointment of the appointees shall be subjected to the final out come of the writ petition.
This writ petition has been filed by Vijay Kumar and nine other petitioners challenging the selection of 20 candidates selected for the post of Pharmacist District Cadre Jammu and submitted that respondents have issued select list of the candidates for the post of Pharmacist District Cadre Jammu who are less in merit and obtained less marks in respective qualification than the petitioners. The respondents ignored the petitioners, who are meritorious than the selected candidates.
During the course of arguments Adv Ashok Kumar Basotra appearing for the petitioners submitted that all the petitioners were accordingly directed to appear in the interview from November 7, 2006 to November 9, 2006. The petitioners accordingly appeared in the interview being eligible, qualified and meritorious on the respective dates fixed by the official respondents and done well by replying all the questions put to them by the selection body. The respondents issued select list selecting the candidates with low merit and less marks in the qualification prescribed for the said post of Pharmacist and ignoring the petitioners who were having better merit. Moreover the official respondents did not publish the criteria as well as the marks obtained by the selected candidates. Advocate appearing for the petitioners alleged that respondents seem to have fixed no criteria for this selection and instead adopted “pick and choose”, policy thereby ignoring the candidates having better merit.
