Court denies bail to rapist | | | EARLY TIMES REPORT Jammu, July-19 (JNF):- Special Mobile Magistrate Passenger Tax YP Kotwal today rejected the bail application of Sanjay Sharma alias Sanju who was involved in kidnapped and rape of girl. According to the police case that on June 8, 2011 Sanjay Sharma alias Sanju had kidnapped the prosecutrix and taken her to Kullu Manali (HP) and committed rape on her up to June 12, 2011. On June 12, 2011 he along with the prosecutrix came back to Jammu and after reaching Jammu on June 13, 2011, the applicant fled away, FIR for the commission of offence u/s 366 has been registered on the written complaint filed by the father of the prosecutrix. During the course of investigation IO has recorded the statement of witnesses and arrested the applicant/accused on July 1, 2011. After medical report, the IO investigates the offence u/s 366 (kidnapping) /376 (Rape) RPC which is made out against the accused. Special Mobile Magistrate Passenger Tax YP Kotwal after hearing Advocate VS Saini for the applicant whereas PO Yogesh Bamba for the State observed that Prosecuting Officer has opposed the bail application on the ground that applicant is a habitual offender is also involved in some other FIRs including FIR NO 105/2011 u/s 307/340/341/147/148/323 RPC and 4/25 Arms Act. Upon this Court held that keeping in view the facts and circumstances of the case, the nature of the evidence in support of prosecution, the character, behaviour and standing of the accused the offence being against the weaker section of the society, Court is of the considered view if the accused is admitted to bail, he may hamper and temper with the prosecution evidence and his moving in the outside, society will have deleterious effect on the minds of the public at large and dismissed the bail application.
