| Directs Insurance Company to pay Rs 84 lacs and Rs 88 lacs to the claimants | | HC modified award | | EARLY TIMES REPORT
Jammu, July-22 (JNF):- In two cross-appeals filed by the Insurance company and claimants in a accident case which took place on January 19, 1997 when Devinder Nagpal, Kewal Nagpal, Geeta Nagpal and Anju Nagpal while going to Amritsar from Jammu by Maruti Car met with an accident near Ghagwal on the National Highway.
Davinder Nagpal succumbed to the injuries at Delhi Hospital whereas Kewal Nagpal could not recover from the injuries and was rendered 100% disable. A claim was filed by kith & kins of deceased Devinder Nagpal seeking Rs 4,19, 000, 00/- along with interest whereas Kewal Nagpal also filed claim seeking Rs 3, 88, 14, 000 as compensation. The Tribunal found the claimants entitled compensation Rs 99, 97, 328/- along with interest @9% for the kith and kin of deceased Devinder Nagpal and Rs 1, 10, 24, 634 along with interest awarded to Kewal Nagpal. The insurance company challenged the claim and the family members of the deceased and injured and seeking enhancement.
Justice JP Singh of Jammu & Kashmir High Court Jammu Wing after hearing both sides modified the claim of deceased Devinder Nagpal from Rs 99, 97, 328/- to 84, 29, 000 and interest @ 7.5% instead of 9% and also modified the claim of Kewal Nagpal from 1, 10, 24, 634 to Rs 88, 60, 000 along with interest.
