| HC quashes PSA of OGW LeT | | | EARLY TIMES REPORT
Jammu, July-25 (JNF):- Justice Hasnani Massodi quashed the detention order passed by District Magistrate Rajouri on December 21, 2010 whereby one Quresh Ahmed s/o Lt. Abdullah resident of Village Panghai Tehsil Thanamandi District Rajouri alleged Over Ground Worker and Courier of banned militant Organization LeT. Detenue Challenged his detention order under Public Safety Act District Magistrate Rajouri.
While quashing the detention order, the Court after hearing the parties observed that as per ground of detention the involvement of the detenue in various FIRs has weighed heavily with the detaining authority while slapping detention on the detenue, it was necessary for the respondents to provide detenue copies of FIRs and concerned material so as enable the detenue to make an effective constitutional and statutory safe-guards. Failure on the part of detaining authority to discharge their constitutional and statutory obligation has again rendered the detention order unsustainable. With these observations Court allowed the petition and quashed the detention order passed by District Magistrate Rajouri on December 21, 2010, with the direction to respondents to release the detenue forthwith from preventive detention order.
