SC’s direction to file petition against Bhatta-Parsol Kisan leader in DelhiHigh Court

New Delhi, July 26: A Division Bench of the Supreme Court of India comprising G.S. Singhvi and H.L. Dattu today after hearing the petition filed against the abduction and illegal detention of Bhatta-Parsol Kisan leader, Manveer Singh Teotia directed arguing counsel, Bhim Singh to file this petition in the High Court of Delhi.
Manveer Singh Teotia was abducted by the UP police, according the writ petition filed by his mother, Harviri Devi, from Delhi on 9th July, 2011. Bhim Singh submitted that a press reporter had filed FIR no. 135/2011 in the Tilak Marg police station in this matter which is still under investigation.
He further submitted that this abduction was in violation of Article 21 of the Constitution of India as Uttar Pradesh Police had no jurisdiction to arrest a person in Delhi without the application of the norms and procedure laid down in Section 79 & 80 of Criminal Procedure Code.
The Code requires that Uttar Pradesh Police should have taken permission from the competent authority and the police station in Delhi which Uttar Pradesh Police failed to do.

Bhim Singh also said that administration in Uttar Pradesh intend to liquidate Teotia under the excuse of an encounter or otherwise. He submitted that arrest of Kisan Leader was in utter violation of the law laid down by the Supreme Court of India in D.K. Basu’s judgment also. The State Legal Aid Committee shall be filing the petition in the High Court of Delhi on Wednesday, 27th July, 2011 as per direction of the Supreme Court of India.
