HC adjourns writ for revival of SAC

Jammu, July-26 (JNF):- The High Court today adjourned a petition
seeking revival of SAC and appointment of its chairpersons after
hearing the Additional Advocate General. The petition is filed by one
Virender Sudan
The AAG requested the court that the meeting of Statutory Committee
to recommend the Chairperson and Members of State Accountability
Commission is stated for July 30, 2011and he would report the outcome
of meeting to the Court by the next date, Upon this Court directed the
Registry to list this petition in the second week of August, 2011.
The petitioner's complaint along with 272 complaints are pending
before the State Accountability Commission and the people are
suffering for want of justice, seeking direction to the State of Jammu
& Kashmir through Chief Secretary and Chief Minister in his capacity
as Chairman of the Committee for appointment of Chairperson and
Members of J&K Accountability Commission to appoint the Chairperson
and Members of Jammu & Kashmir Accountability Commission and restore
the functioning of the J&K Accountability Commission.
The petitioner submitted that the whole nation vying for Lok Pal and
Civil Society and the Govt is struggling for a Lok-Pal to check menace
of the corruption eating the vitals of the nation, here in the State
of J&K virtually a Lok Pal had taken birth in the year 2002 and made
functional in 2004/2005 but the in action on the part of respondents
have virtually made this institution dead as the Commission’s Chairman
and the members have not been appointed since four/five years.
In the petition it has been submitted that every appointment shall be
made after obtaining the recommendation of a committee constituting of
Chief Minister as Chairman, the Speaker of Legislative Assembly, Chief
Justice of the State High Court Member, Law Minister of the State
Member and Leader of Opposition in the Legislative Assembly as Member.
After the resignation of Late Justice RP Sethi (Retired Judge of
Supreme Court of India), the respondents never appointed Chairperson
but senior member Justice GL Raina (Rtd) was made the acting
Chairperson and after his expiry of terms neither any member was
appointed and nor any chairperson was appointed and Justice Muzaffar
Jan (rtd) was the lone member leaving the SAC defunct and lifeless and
institution which was made for the people and to check the politician,
executive and police was made lifeless and defunct, seeking
appointment of Chairperson and members of the SAC.
The petitioner prayed for issuance a mandamus directing and
commanding the respondents to appoint the chairperson and members of
the State Accountability Commission and restore the function of the
Jammu & Kashmir Accountability Commission.
Earlier Additional Gagan Basotra appeared for the State and was
directed by the Court to file reply and present situation by or before
July 25, 2011. JNF
