| Petition for recovery of sales tax treated as PIL | | 861 defaulters to pay Rs 1000 Cr | | EARLY TIMES REPORT Jammu, July-27 (JNF):- A Division Bench of Jammu & Kashmir High Court comprising Justice JP Singh and Justice Hasnain Massodi today treated the petition for recovery of more than Rs 1000 crores as Sales Tax/ VAT from about 861 defaulters as Public Interest Litigation and issued notice to State of Jammu & Kashmir through Commissioner/Secretary Sales Tax Dept, Commissioner Commercial Tax J&K Govt, Deputy Commissioners Commercial Tax Recovery Srinagar/Jammu, SSPs Srinagar/Jammu. The notices accepted by Adv Rohit Kapoor for the four respondents and AAG Gagan Basotra accepted notice for both the SSP. The court after hearing the parties observed that s per the arguments of Senior Advocate Sunil Sethi, Division Bench is of the view that petition needs to be treated as PIL and it be registered as such and directed respondents to response to the petition along with status report indicating the steps taken by them to recover tax and directed registry to list this PIL after four weeks.
This PIL has been filed by convener Sangarsh RTI Movement and Ors seeking direction to the respondent-State to recover the amount of Sales Tax & Vat from all the defaulters, who had failed to pay the sales tax under the J&K General Sales Tax Act and J&K VAT Act for which according to the petitioners no action has been taken by the respondents till date, such an amount comes to about to Rs 1000 crores and may be even more. There are about 861 defaulters who have evaded from payment of Sales Tax/VAT. JNF
