Application for supplementary Challan filed | Chopra Family murder | | EARLY TIMES REPORT Jammu, July-27 (JNF):- An application filed by Puneet Chopra s/o Lt. RB Chopra in the State High Court prayed for issuing the direction to State of J&K through Financial Commissioner Home, DGP J&K & Special Investigating Team headed by DIG Jammu to file supplementary challan in case FIR No 107/2006 (Murder of Chopra Family) u/s 302 RPC before elapsing of 60 days period from the first remand of the alleged accused person.
According to the application filed by the son of the Lt RB Chopra submitted that a petition is pending for disposal in the state High Court in which the petitioner has challenged the decision of state Govt whereby the State Govt requested CBI for carrying out the investigation into the FIR No 107/2006 (murder of RB Chopra, his wife Madhu Chopra, daughter Solani Chopra, House Servant Sonu and Driver Jagan Nath) together with the communication No HOME/ISA/143/2006 dated February 25, 2011 addressed to Secretary Govt of India, Ministry of Personal, PG&Pensions (Dept of Personal & Training New-Delhi) requesting for CBI investigation into the said brutal murder of five persons. The petitioner has sought direction to the respondent to allow the Special Investigating Team constituted by the Govt, headed by Mr. Farooq Khan DIG Jammu-Kathua Range to complete further investigation into the FIR No 107/2006.
In the application it has been mentioned that the High Court on March 10, 2011 after considering the petition and hearing the counsel for the petitioner has issued notice to the respondents and directed them to produce the record which resulted in issuance of SRO and also directed DIG to file status report of the case.
The applicant has further submitted that during the investigation by the SIT. Some substantive investigative material was found on the basis of some very influential persons have been arrested and are presently in judicial custody. These influential persons who have been recently arrested, investigation has been majorly completed as per the report coming in the print-media and has been reported in the print-media that supplementary challan will be filed against the accused person on July 23, 2011 and the accused persons will also be produced before the Court on July 23, 2011. In the application it has been submitted that as 60 days period as per the provisions of CrPC for filling of challan is going to be over within few days and given the consequence of events which have taken place the petitioner as genuine and real apprehension that the deferment and non-filling of the challan before the Court has been deliberately done and efforts will be made not to file the challan within the stipulated period, so that the accused persons are in a position to get the bail u/s 167(2) CrPC.
