Court awards 3 yr imprisonment to Pak National

Jammu, July-29 (JNF):- Special Municipal Mobile Magistrate Jammu SS Bali has convicted and sentenced Wahid Aslam s/o Naseer r/o Old Iqbalbad Drig Road, Karachi, Pakistan u/s 14-A Foreigner's Act and Section 3 Indian Passport Act r/w section 212 RPC to undergo three years imprisonment.

According to the case against the accused persons namely Manu Gill s/o Sagar Gill r/o Jaswan Tehsil & District Jammu and Wahid Aslam are that accused Wahid Aslam crossed Indo-Nepal Border without valid passport with the assistance of Manu Gill who provided him food & shelter beside this accused Manu Gill has also provided him residential accommodation. Police after due investigation submitted that Charge-Sheet against accused Wahid Aslam u/s 14 Foreigners Act and 3 IPA.


Senior Prosecuting Officer Rohit Gupta during his arguments stated that in view of the allegations leveled against accused Wahid Aslam is made out, on the other hand Adv Waris Gill appearing for the Pak National has submitted that on the basis of investigation conducted by the IO offence 14 Foreigners Act and 3 IPA was made out and not the offence 14-A Foreigners Act. The accused has visited Indo-Nepal Border from Pakistan with valid passport; however, innocently accused crossed to Indian Territory and prayed for lenient view may be taken in the matter.
The court after hearing Senior Prosecuting Officer Rohit Gupta and careful perusal of record, the court is of the opinion that offence u/s 14-A Foreigner's Act and Section 3 Indian Passport Act made out against Wahid Aslam and in view of the fact that accused is religious missionary, this fact is event from the documents placed on the record. With these observations Court convicted and sentenced to undergo imprisonment two years u/s 14-A Foreigner's Act and one year under Section 3 Indian Passport Act and clarified that both the sentences shall run concurrently.
