Shoddy investigation leads to acquittal of narco smuggler
Jammu, July-30 (JNF):- Principal Sessions Judge Bala Joyti acquitted Mohd Yousuf S/o Ghulam Yatoo R/o Darshipora Tehsil Banihal with the observation that Shoddy and unmindful investigation leads to acquittal of accused who was facing trial for allegedly commission of charges u/s 8/20 NDPS Act.
The Court acquittal judgment observed that various other anomalies in prosecution evidence“cases under N.D.P.S Act should be handled only by those police officer(s), who has been imparted special training in this regard and are in know of the provisions of the Act. Mishandling of the case of this type has far reaching effect, which in turn, can disturb the entire social fabric.
Court further observed that said that the drug trafficking is engulfing the society like malignant vice & it is high time that measures are taken to control this fast spreading menace. Court tempted to put a serious note on record about the manner of investigation in which NDPS cases are dealt by inexperienced police officers. Court would like to observe that the cases falling under NDPS act are to be taken lightly/casually neither by the prosecution nor by the court. Court wish, the authorities give a sincere thought and act according to the advice that has come from the highest judicial court of the land as well as of the state as any infraction in compliance will only boost the moral of the drug peddlers, drug mafia all behind this kind of organized crime that has engulfed the society and has been menacingly jeopardizing.
