Remove petitioner from register No 10: HC

Jammu, August-01 (JNF):- The High Court today directed the state to remove petitioner, Sumanrt Singh’s name from Register No 10. The said register enlists names of criminals and unscrupulous elements.


The petitioner pleaded that his name in Register No 10 maintained by the State respondents was unjustified and even otherwise illegal as the Rules Governing field had not been followed by the respondents before entering the petitioner's name in the Register No 10.

Justice JP Singh of Jammu & Kashmir High Court Jammu Wing in an approved for reporting judgment after hearing the parties observed that during the Course of hearing it was conceded by the state counsel that the petitioner was not heard before his name was entered in Register No 10. It was also not disputed and in presence of the copies of the judgments of Courts placed on record by the petitioner, the petitioners stand acquitted in all the cases referred by the State in their objections. The state respondents have not placed on record any material of any type whatsoever to substantiate their plea that the petitioner was a bad character and had accumulated wealth by resorting to land grabbing and indulging in white collar crimes.
While directing the state respondents, Court further observed that entry in the Register No 10 cannot be made on mere ipsi dixit of a police officer indicating any one as bad character in the absence of any material in support thereof. The entry of name of petitioner in Register No 10 by the police without following the rules framed under the surveillance of bad character circular and in absence of any sustainable material justifying inclusion of his name in the Register No 10, therefore, offence, the petitioner's right to personal liberty granted under Article 21 of the Constitution of India. The state respondents are required to delete the petitioner's name from the Register No 10 and directed that state-respondents to remove forthwith the petitioner's name from register No 10. Meanwhile in an identical petition filed by Tulsi, the Same Court has directed the respondent-state to delete the name of petitioner from Register No 10. JNF
