| HC quashes PSA | | | EARLY TIMES REPORT
Jammu, August-01 (JNF):- The High Court today quashed the detention under PSA of
Ashiq Hussain who was detained under PSA vide the order of District Magistrate Doda passed on February 2. 2010.
The petitioner Ashiq Hussain s/o Gulla Bhat r/o Kilhotran Tehsil Gandoh District Doda under challenged the detention and Justice Hasnain Massodi after hearing the parties perused the records which show various FIRs registered against the accused under various sections including rape, attempt to murder & dacoity. The court observed that as per the ground of the detention the involvement of detenue in various FIR has weighed heavily with the detaining authority while slapping detention on the detenue. It was necessary for the respondents to provide the detenue copies of FIRs and connected material so as to unable the detenue to make an effective and meaningful exercise of constitutional and statutory safeguards. Failure on the part of the detaining authority their constitutional and statutory obligation has again rendered the detention order unsustainable and quashed the detention order passed by the DM Dodaith the direction to release the detenue forthwith from preventive detention.
