HC treats writ as PIL

Jammu, August-02 (JNF):- The High Court today treated a petition seeking implementation of Dowry restrained Act in letter and spirit as a Public Interest litigation (PIL).
Justice JP Singh after hearing Senior Advocate SS Lehar treated the petition as Public Interest Litigation with the observations that writ petition filed by one Meharban Singh raises questions of public interest, directed Registry to list this case before the appropriate bench under rules.
In the petition it has been submitted that the petitioner is Social Worker and is highly influenced from the dowry deaths taking place through out the state for the non-fulfillment of dowry demands and submitted that the State is under an obligation to formulate rules for the implementation of dowry restrained act in order to punish or panelized the persons who are abetting or committing the offences under the said Act, what instead the weaker sex i.e. girl are punished, harassed and forced to commit suicide because of the demands of the dowry.
The non-implementation dowry restrained act and non-framing of rules is violation of the legal statutory and fundamental rights of the girls and they are facing gender inequality because of this. In the petition it has been prayed by the petitioner that Court issued direction to the State respondents to implement the Dowry Restrained Act 1960 and further directed the respondents to make the rules for the purpose of dowry restrained act as that proper enforcement of the Act can be done.
