| HC quashes PSA of HM’s `Lady Militant’ | | | EARLY TIMES REPORT
Jammu, August-02 (JNF):- Justice Hasnain Massodi of Jammu & Kashmir High Court Jammu has quashed the detention order under PSA of a suspected HM militant Iqbal BI w/o Shoket Hussain r/ Solian Tehsil Surankote District Poonch who was detained under PSA for a period of two years.
According to case that husband of Iqbal Bi was a Pakistan Trained Militant of HM Outfit and active in the area during the July 2001. She along with her husband crossed to POK and there she lived for about 10 years in a camp and met with ISI officials and returned after 10 years by crossing the territory on February 24, 2011 and was apprehended by the Army and was handed over to local police. The local police arrested and registered a case 2/3 E&IMCO P/S Poonch and was enlarged on bail. According to the police recommended to DM Poonch for detention under PSA she has remained indulged in activities which are highly pre-judicial, anti-national and desperate in character. The District Magistrate Poonch issued detention order under PSA for a period of two years.
The court after hearing the parties observed that the reference to the activities of HM is rendered meaningless in view of non-description of the organization with which the detenue is alleged to affiliated. The detenue is alleged to have provided food & shelter to militants of different outfits. The detaining authority fails to inform the detenue with sufficient clarity the particulars of the militants whom she is engaged to have provided food and shelter and details of the food and shelter with the places where such food and shelter was made available. With these observations Court quashed the detention under PSA of Iqbal BI with the direction to the authority to release her forthwith. JNF
