| DB forbids construction in Channi-Himmat | | | EARLY TIMES REPORT
Jammu, August-04 (JNF):- The High Court today forbade construction on a plot of land measuring 4 Kanal 10 marlas situated in village Thanger Channi-Himmat Jammu. The decision was taken in a contempt petition filed by Ravinder Sawhney and others .The High Court also directed SSPJammu to ensure compliance.
While issuing directions, Division Bench observed that while
drawing attention to the averments made in the statements of the fact,
Adv Choudhary appearing for the Board submitted that before passing
order dated June 6, 2011 by this Court, Housing Board has already
stopped the construction work on the land in dispute, but for fencing
of Green Belt which was taken by the Housing Board before passing of
the order dated March 18, 2011 in facts and the circumstances of the
present case the Division Bench directed MD Housing Board to ensure
that no construction on the land dispute.
It is worth mentioning here that the petitioner claims
that he had more than 5 Kanal Lands and this disputed land measuring 4
Kanal 10 Marlas adjoining to his land, he has applied for
regularization under Rohsni Act which was allowed but the Housing
Board filed an appeal against that order and started construction on
the dispute land (green belt). Upon this petitioner filed this
contempt petition, DB issued directions to Housing Board & SSP Jammu.
