| Student gets bail under NDPS Act | | | EARLY TIMES REPORT
Jammu, August-06 (JNF):- First Additional Sessions Judge Jammu KS Parihar granted bail to Sukhpreet Singh a student of BA Final who was arrested by the police on July 26, 2011 while the accused was
traveling on a motorcycle from Jewel Chowk to Bhori and on enquiry the accused disclosed his identity and on search of his person a while colored polythene packet containing 600 grm charas was recovered and a case u/s 20 NDPS Act was registered against him.
In the detailed bail order, the Court observed that seized contra banned admittedly falls much below the commercial quantity, therefore, rigors of section 37 NDPS Act are not attracted
to present case and the prayer of the accused can be dealt with under the provisions of CrPC. Admittedly the accused is in custody since of date of arrest and is custody is not more required by the
Investigating Agency. Court find no reasonable ground to perpetuate the detention of the accused in custody any more and the accused is accordingly admitted to bail and directed him to deposit a cash
security of Rs 10,000/- with surety and personal bond in the amount of Rs 25000/- each, failing which he shall remain in judicial lock-up.
