Man gets job after 8 years of litigation
HC directed to appoint petitioner as Constable

Jammu, August-10 (JNF):- Justice Muzaffar Hussain Attar in a significant judgment directed the respondents to appoint petitioner Nishan Singh on the post of
constable within a period of two months.

In the petition it was submitted that in the year 2002 in
pursuance of the policy decision of the State Govt to make on spot
recruitment in the State Police, on spot selection process was
conducted by the respondents in which petitioner qualified physical
test, provisional selection list was notified in which petitioner
figured at serial No 10 but petitioner was not ultimately appointed
and filed a petition in the State High Court.

The petitioner after more than eight years litigations in
Court and in the shape of representation before the DGP has ultimately
came to High Court.

The Court observed that presumption is that the order passed in favour of Ravinder Singh, petitioner was to be given same treatment in view of the statement
made by the counsel for the respondents during the content proceedings
and petitioner could not be denied appointment in the manner same has
been denied to him in terms of impugned order. Respondents have not
acted in just manner in denying appointment to petitioner and quashed
the order dated September 25, 2009 by passed State and directed to
respondents to appoint the petitioner on post of constable within a
period of two months from the date copy of this order is served to
them. Court made it clear that respondents will not entertain any like
claim and even not appoint any other person in the manner which it is
directed in this judgment. Court further provided that upper age limit
fixed for appointment of constable shall be deemed to have been
relaxed in respect of the petitioner in view of the peculiar facts and
circumstances of this case. JNF
