HC settles controversy over appointment of ReTs

Jammu, August-12 (JNF):- The High Court today settled controversy over engagement of RETs by directing that one of the teachers in Primary School Chalpora must have Arts background.
In a petition the petitioners submitted that
ZEO Rajwar vide notification dated February 27, 2009 invited
applications from the eligible candidates for the post of Rehbar-e-Taleem Teacher in upper primary school Chalpora. The petitioner having BA B.Ed qualification has claimed for being engagement was ultimately considered by the Director Education and rejected on vide order dated June 17, 2010 on the ground that under the SSA Norms amended from April 1, 2008 all the vacancies in upgraded
primary schools are to be filled up from the candidates having math/science background. Feeling aggrieved the petitioner filed this petition and challenged the order of Director School Education on the ground that according to the documents that Head Master SSA Middle School Chalpora requested ZEO to depute one teacher having arts background as the school is in need of Urdu/history knowing teacher and rest of the classes are functioning normally. Justice Muzaffar Hussain Attar after hearing the parties observed that in norm (d) it is provided that of the three teachers sanctioned under SSA for every new upper primary
school, one each will need to be a teacher with mathematics and
science specific educational background. It become writ large on the
face of record that 3rd teacher in terms of Norm (d) would be a person
having art background. Moreover the headmaster in his communication
has not projected need for having math/science education background
teacher but has requested for Art Back Ground teacher. The order of
Director School Education dated June 17, 2010 is not legal and said
authority has applied its mind to entire conspectus of the case but
has simply rejected the claim of the petitioner. With these
observations Court allowed the petition and quashed the order of
Director School Education dated June 17, 2010 and directed the
respondents to consider the petitioner for engagement as ReT within 15
days from the date a copy of this order is served upon them. JNF
