Court awards 2 years RI, fine to Revenue Official | | | EARLY TIMES REPORT Jammu, August-16 (JNF):- Special Judge Anticorruption Jammu Pawan Dev Kotwal today awarded rigorous imprisonment of two years and fine Rs 15000/- to OM Parkash s/o Jatu Ram then Patwari Halqa Pamote Tehsil Ramnagar District Udhampur who was caught red-handed by the VOJ in the year 2006. According to the VOJ case that on a complaint of one Tej Ram P/S VOJ on July 10, 2006 with the allegations that he applied for the demarcation of his land allegedly owned by him jointly with his brother but he was holding less share, that Tehsildar Udhampur marked application on June 10, 2006 to OM Parkash Patwari Halqa, when complainant handed over the application to Patwari he demanded Rs 5000/- from the complainant for demarcation, complainant paid 3000 as bribe to Patwari, though the land was demarcated on June 25, 2006, but despite several requests Patwari refused to handover the demarcation report and other documents and demanded Rs 2000/- more as bribe which was settled to pay on July 10, 2006. Upon this complaint, the VOJ registered a case and trap team was constituted which was laid the trap and caught red-handed while accepting the bribe. The Court after hearing CPO Parshtom Sharma and counsel along with accused, observed that accused is held guilty of both the charges u/s 5(1) (d) r/w 5 (2) PC Act and 161 RPC and is convicted accordingly. While awarding sentence Court further observed that as far as quantum of sentence is concerned it is hard reality that corruption in public offices has assumed an alarming concerned and to save the civilized society for menace, corruption officers/officials need to be dealt with sternly, but Court has also to considered mitigating circumstances, if any favour of the accused and shall imposed appropriate sentence in the given facts and circumstances. In the present case accused is lower rug public servant and has faced trial for five years and obviously went trauma during this period. He is at the verge of his retirement and consequence of conviction against him is losing of his service which would definitely affect is family members, without any fault of their part. Therefore, too harsh sentence would at the cost of innocent family members and this in appropriate facts and circumstances accused is sentenced rigorous imprisonment for one year u/s 5(2) PC Act and also to fine Rs 10,000 and he is also sentences to under go 1 years RI and fine Rs 5000 in 161 RPC. Court further clarified that both the sentences shall run concurrently. The accused who was present in the court was taken into custody and sent to District Jail Jammu. JNF JNF/AUGUST/16/2011/2
