| DB restrains State from making promotion to SPO | | | EARLY TIMES REPORT
Jammu, August-17 (JNF):- A Division Bench of Jammu & Kashmir High Court
comprising Justice Virender Singh and Justice JP Singh in
number of LPAs filed against the judgment of Single Judge dated April
28, 2011 restrained the government from effecting promotions of prosecuting officers.
While staying the judgment of Writ Court, Division Bench
after hearing the parties observed that the Court is of the view that a case
has been made out requiring admission of these appeals to final
hearing at a very earlier date and admitted all the appeals to hearing
with the direction that list for final disposal in the week commencing
from September 12, 2011.
The Court further said that until the matter comes up
for consideration the operation of the judgment impugned dated April
28, 2011 in the appeals is stayed. DB further directed that no further
promotions shall be made by the State respondents to the post of
Senior Prosecuting Officer until next date. JNF
