Court returns Challan to VOJ for bifurcation
`Illegal’ Appointment in SKAUST Jammu

Jammu, August-20 (JNF):- Special Judge Anticorruption Jammu Pawan
Dev Kotwal has returned the challan along with documents to the
Investigating Agency VOJ with the direction that Charge-Sheet be
bifurcated and separate charge-sheet for separate offences be present.
According to the challan the allegations against the accused
namely Nagendra Sharma then Vice Chancellor of Sher-e-Kashmir,
University of Agricultural Sciences and Technology Jammu hatched
conspiracy with accused Ashok Kumar Koul then Registrar, Iqbal Singh
then Estate Officer now executive engineer and Vijay Kumar SOI then
Comptroller SKUAST Jammu and also with accused Vishal Tandon, Vinayak
Virkam, Narinder Kumar Raina and M/S Ankur Sharma all beneficiaries
and two others disciplines in the University with following prescribed
Rules by manipulating records and against non-existing posts without
financial budgetary support, against the eligibility criteria fixed
for the posts and also in excess of number of vacancies notified in
the advertisement notices, illegally and dishonestly for benefit the
beneficiaries.

Special Judge Anticorruption Jammu Pawan Dev Kotwal
further observed that the allegations constitute though same of
offences of the same kind but, each offence is separate and all the
offences are allegedly committed on the different occasions and also
the offences are more than three in number to bring same within the
purview of section 234 CrPC as far as accused then Vice Chancellor and
then Registrar is concerned. With these observations Court returned
the charge-sheet along with documents to the Investigating Agency
through CPO with the direction that charge-sheet be bifurcated and
separate charge-sheet for separate offences in the light of provisions
be presented. Court further directed that the investigating agency
that they shall make every endeavor to present the charge-sheets as
early as possible. JNF
