| DB takes serious note of non-compliance of HC | | Directions by Director Education | | Jammu, Dec 01 The Division Bench of the Jammu and State High Court has banned the moment of tractor trolleys within the city and directed IGP, SSP and SSP Traffic Jammu to take necessary steps to enforce the ban by checking patrols at Police Check posts to ensure that no tractor trolley was allowed entry within the city limits which were being used for commercial purposes, a major nuisance in the city and contravenes the provisions of the Motor Vehicles Act. The Division Bench comprising Chief Justice B A Khan and Justice Imtiyaz Hussain gave this direction in a writ petition filed by All J&K Taxi Sumo Transport Union, which was treated as Public Interest Litigation. Taking serious note of the tractor trolleys being used for commercial purposes, the DB banned their entry within the city limits and directed the concerned Police and Traffic authorities to implement the ban in letter and spirit. On regularization of traffic, the DB found satisfactory the compliance reports submitted on behalf of Army, CRPF and BSF, directed General Officer Commanding of Northern Command and Western Command to explore the possibility of deployment of Traffic Police at some points in Jammu City in coordination with civil traffic authorities. Taking serious note of the non compliance report by the of the Director School Education who is already under contempt notice, the DB said that it is not known what prevents him from taking action against those who had failed to respond to his notice and granted one final opportunity to take necessary steps to implement the Court directions to submit his status-report before the Court. Regarding eight member expert committee set up by the Government to examine the issue of the age of the commercial vehicles, DB directed that they shall submit report to the Chief Secretary within three weeks. DB further ordered that the report of the committee set up by the Government under orders of this Court to identify sites for bus bays, passenger shelters, over-head bridges, sub-ways, speed-breakers etc has not received due attention from the concerned authorities and granted one months’ time to all concerned state functionaries to accord necessary sanctions and clearances in this behalf besides reexamining the estimates and directed Chief Engineer, PWD to proceed with setting-up of these bus bays, speed breakers and painting of these road markings etc which does not involve much of a financial implication and which shall be completed within one month of receipt of this order. Taking serious note of the delay for issuing sanction for Chaamb-Jourian bus stand the DB directed Chief Secretary and other concerned authorities to examine the matter and to ensure that sanction was expedited and accorded with in one month from this order while VC JDA was directed to directed to expedite preparation of DPRs and submitt the same to the concerned ministries by February 15, 2007 and he shall also take necessary steps for submitting the city development plan to Ministry of Urban Development, Government of India and initiate preparation of DPRs for this plan and also complete preparation of DPR for the traffic plan of Jammu City. Division Bench directed PCB to set up necessary mechanism to put into operation the two Pollution control vans and start checking of pollution centers of vehicles and to take necessary follow up action against defaults on the basis of such tests.
