| Militant involved in firing on Dr Ashok Bhan acquitted | | | Jammu, Dec 1 Presiding Officer TADA Court Wani ND has acquitted Javed Ahmed Churisa s/o Ghulam Mohd r/o Mehman Mohalla Anantnag, who was facing trial in a case, took place on August 3, 1990 for attacking on the then SSP Anantnag Dr. Ashok Bhan presently Commissioner State Vigilance Organization and other security guards. According to the prosecution case on August 3, 1990 P/S Anantnag received information that at about 1:00 PM some unidentified militants armed with deadly weapons and ammunitions in order to create terror entered into Court complex through the main gate of District Police Anantnag and fired upon Dr. Ashok Bhan, the then SSP Anantnag, when he was just to step in his car also and fired upon the security guards with intention to kill them. The accused also lobbed a grenade in which Dr. Ashok Bhan SSP Anantnag, constables Mukesh Kumar, Hari Singh, Mohd Akram, Bashir Ahmed and Abdul Khaliq were injured and building of the police garage got damaged. The police retaliated and accused fled away. The injured were shifted to hospitals for treatment and SSP Dr. Bhan was taken to Srinagar for treatment. A case FIR 285/ 90 u/s 302/ 307/ 34 RPC r/w 3-2 (I-II) 5 under TADA Act was registered and apprehended Manzoor Islam s/o Abdul Majid Bhat who died during trial. Wani ND while deciding the case after about 16 years observed that the statement of Ashok Bhan and other witnesses reveal that they have stated about firing made by unknown militants. According to statements two police guards Mukesh Kumar and Hari Singh in this process sustained injuries. But who resorted to this indiscriminate firing or lobbing of grenades is yet a mystery. It is not proved that the accused facing the trial have fired at the witnesses at the time of occurrence. The fact could have been proved had the prosecution examined R Tickoo to prove the statement recorded by him in terms of section 15 of TADA but this has not been done, so there is no evidence against the accused, under theses circumstances the accused is acquitted from the charges leveled against him.
