HC dismisses petition against Sales Tax department | | | EARLY TIMES Jammu, Aug 22: In an ‘approved for reporting’ Judgement given in two petitions filed by Siemens Limited wherein it had called in question tax demand of more than eighty lakhs, Justice J.P. Singh of J & K High Court while dismissing the petitions interpreted the definition of “goods” and “sale” under Sales Tax Act.
It was contended by Tax Department Counsel Rohit Kapoor the service tax was leviable on total value of the contract.
The company was un-registered dealer as works contractor. The company had to commission Multi -Slice CT scanners in the State.
The findings recorded by assessing authority Lakhanpur Check Post have found to be correct. The sales Tax Department was represented by its advocate Rohit Kapoor while DC Raina senior advocate with Ananta Raina represented the petitioner company.
