BJP flays marriage registration rules in Jammu and Kashmir | | | EARLY TIMES REPORT Jammu, Aug 26 : The BJP today flayed the Jammu and Kashmir government for being discriminatory in implementing marriage registration rules. "The legislation power in Jammu and Kashmir is being used with negative approach and terminology of justification and do not find its place in Omar Abdullah-led coalition government," BJP spokesperson Ramesh Arora told a press conference here.
He said, "People in Jammu and Kashmir are going to face blow of religion-based discrimination in the shape of compulsory marriage registration rules." The state government has drafted proposed the Hindu Marriage Registration rules under section 8 (1) of Jammu and Kashmir Hindu Marriage Act, 1980.
"As per the drafted rules, every marriage will be registered under purposed rule 5 of registration but Muslims and Christians are exempted as no rules has been framed for them," he said and added that power of registration is given to Tehsildar and Naib-Tehsildar, whose offices are already known as a hub of "corruption" and under rule 6, marriage will be registered at a place of solemnisation.
He said if a Hindu from Bani marries at Paddar, he has to approach to the local Tehsildar for registration and the tehsildar refusing it or harassing the couple cannot be ruled out.
He said the government wants to implement directions of the Supreme Court passed in transfer petition in Seema vs Ashwani case, where registration of all marriages in different religions was made compulsory.
"Legislative must put pressure on the government to desist from irresponsible approach and public must react to it by all means," said the BJP leader.
He, however, condemned Chief Minister Omar Abdullah and PDP patron Mufti Mohammad Sayed for their remarks made over Gandhian activist Anna Hazare.
