| HC stays termination of doctor | | | EARLY TIMES REPORT
Jammu, August-26 (JNF):- Justice Mohd Yaqoob Mir of J&K High Court Jammu Wing in a significant order stayed the termination of Dr. Muneer Afzal Baba who was terminated from the service by the order of CMO Jammu on August 05, 2011.
Court after hearing the parties issued notice for filling objections to Commissioner/Secretary Health & Medical Education, Director Health Service Jammu, CMO Jammu and BMO Sohanjana Jammu and further ordered that respondents shall also consider the release of salary in favour of the petitioner with effect from March 10, 2011.
According to petition that petitioner Dr. Muneer Afzal Baba was appointed by the order of Director Health Services Jammu whereas he was terminated on August 5, 2011 by the order of Chief Medical Officer Jammu. According to the petitioner that CMO is not his appointing authority, as per the Service Rule only appointing authority removed the employee from the service as such the order of CMO is illegal and unconstitutional.
