Two faces of National Conference
Accept Or Quit

JAMMU, Aug 26: The National Conference, which has been ruling the state with the Congress' support and perpetrating injustice after injustice on the Dogras, has two faces and two stands. In New Delhi, the NC, which is also part of the Congress-led UPA, has been giving unflinching support to the Congress and talking about the supremacy of the Indian Parliament. These days, the NC leadership is shedding crocodile tears and saying there is nothing wrong with the Anna Hazare's crusade against corruption. At the same time, it is saying that the elected representatives in the Parliament alone have the mandate to enact laws and that nothing should be done that has the potential of undermining the authority of the Parliament.
However, in Jammu and Kashmir, the NC behaves differently. It consistently accuses the Union Government of eroding the autonomy the state at the behest of Sheikh Abdullah obtained before his arrest on August 9, 1953 on the ground that his activities were seditious and that he had been conspiring against India to ensure the separation of Kashmir from the nation. So much so that it came out with an autonomy report in 1999, which suggested withdrawal of all the Central laws and institutions saying the same had eroded the internal autonomy.
Between 1999 and till date, the top-ranking leaders of the NC, including Farooq Abdullah, his brother Kamal Mustafa and his son and Chief Minister Omar Abdullah, have umpteen times taken on New Delhi and accused it of bringing the state under the jurisdiction of several Central laws and institutions using foul means and willfully eroding the so-called identity of Kashmiri Muslims through the application of the Central laws. This notwithstanding the fact that the NC shared power with the BJP at the Centre and notwithstanding the fact that it is sharing power with the Congress these days. The attack of the NC on the Union Government all along has been scathing. In fact, the NC leaders like Sheikh Abdullah, who was one of the members of the Indian Constituent Assembly and signatory to the Indian constitution; Farooq Abdullah; and Mustafa Kamal have used strong language against the Congress leadership and New Delhi, besides questioning the very accession of the state to India.
The support of the NC to the UPA and its opposition in the state to the Central laws raise many questions. One of the questions could be: How could the NC take part in the debates leading to the enactment of laws in New Delhi - laws applicable to the entire country, barring Jammu and Kashmir? Another question could be: How could it oppose the application of the same Central laws to the state? It votes for the Central legislations obviously believing that the same are good for the country and its people. And, if it votes for the Central legislations on the ground that the same would be beneficial for the country and its people, how could it raises a hue and cry when it comes to the application of the same Central legislations to the state of Jammu and Kashmir?
The NC cannot do so, but it is doing so. This should not happen. Either it should behave as other parties behave or it should come out of the Parliament and say that neither it would participate in the debates leading to new Central legislations nor would it vote for or against the new bills.
However, the problem is New Delhi, which has allowed the NC to play double-role - one in New Delhi and the other in Jammu and Kashmir. New Delhi should take cognizance of this constitutional flaw and tell the NC leadership to behave failing which necessary action would be taken against it. Article 370, under which the state enjoys a special status in the Union, nowhere says provides for such an arrangement. The framers of the Indian Constitution had rejected the Cabinet Mission Plan, which had empowered the states to frame new Constitution for India and had, at the same, suggested that the states could go out of the Indian constitutional framework if they so like.
