HC quashes PSA detention order of bovine smuggler EARLR TIMES REPORT | | | JAMMU, Sept 01: High court judge, Justice Virender Singh today quashed the order of detention of bovine smuggler Musa which was passed by Samba district magistrate on May 23 last. In a detailed reply filed by district magistrate, who is respondent, it was said that the detenue was involved in bovine smuggling and his activities were posing a great threat to the public peace, tranquility and security of the state. It was said in the objection that the detenue was caught red-handed while committing offence for which case FIR No 110/2011 under section 188 of RPC read with section 3/6 of Prevention of Cruelty to Animals Act 1990 was registered against him and his other co-accused and only after that the detention order was passed on May 23, 2011. The counsel for the petitioner brought to the notice of the court that detenue had been discharged in FIR No 110/2011 registered against him by the concerned court. According to the counsel for the petitioner, the entire nexus, as allegedly reflected in the dossier, was revolving around this FIR only and once the detenue stood discharged, it would have bearing upon the present detention order. Justice Singh then quashed the detention order of Musa and ordered that he would be released forthwith if not required in any other case.
