HC directs housing corpn management to complete election process | | | EARLY TIMES NREPORT JAMMU, Sept 01: High court judge, Justice J P Singh, in a bunch of petitions filed by various cooperative housing building societies seeking participation in election process of apex level housing society -- Jammu & Kashmir Cooperative Housing Corporation Ltd -- has directed the corporation’s Board of Management to complete the election process expeditiously, furnishing fortnightly status report about the affairs of the society and the progress made in this regard. Justice Singh, after hearing the counsels for petitioners and respondents, referred to the details of superseding of J&K Cooperative Housing Corporation Ltd and appointment of Board of Management and on the direction of High Court the then 3rd additional district and sessions judge, Jammu, Pawan Dev Kotwal, who at present is special judge anti-corruption, Jammu, was directed to initiate the process of holding afresh the elections to the Board of Directors of the corporation. Out of the electoral college of 42 primary housing building cooperative societies, only 19 societies opted to participate in elections. After scrutiny of the documents, 12 societies were found eligible to participate. Several petitions were then filed by the housing building cooperative societies. After considering the case of each society, the high court observed that the Jammu Cooperative Rural Housing Building Society, Kandoli Nagrota Cooperative Housing Building Society and Advit Swaroop Cooperative Housing Building Society, keeping in view of their offer to clear the amounts payable by them to the corporation, can, therefore, be permitted by the corporation to participate in elections in case they cleared the amount payable by them or their representatives to the corporation within a period of 10 days from this order. The court dismissed the petitions filed by Lake View Cooperative Housing Building Society and others but allowed the petitions of Bahu Cooperative Housing Building Society, Chenani Cooperative Housing Building Society. The court disposed of petition of Vikas Cooperative Housing Building Society with the direction to the Board of Management to permit the petitioner society’s participation in elections in case they deposited the amount payable by them or their representatives to the corporation within a period of 10 days from this order. Non-payment of amount by the society to the corporation would revive their disqualification for participation in elections.
